STANDARD TERMS AND CONDITIONS OF SERVICE & SALE

  1. Application of Terms 
  2. These terms and conditions apply to all real estate brokerage, property management, and development services provided by إيثل هورايزونز - Aethel Horizons. By accepting a quotation or engaging our services, the client explicitly agrees to these terms, waiving their own standard terms unless a specific written agreement is executed between both parties.

  3. Taxes and Statutory Fees (RETT & VAT) 
  4. In accordance with the regulations of the Kingdom of Saudi Arabia, the sale or transfer of real estate is subject to a 5% Real Estate Transaction Tax (RETT), which shall be borne entirely by the buyer unless explicitly stated otherwise in the final sales contract. Furthermore, all brokerage, advisory, and property management services provided by Aethel Horizons are subject to a standard 15% Value Added Tax (VAT).

  5. Brokerage & Service Fees 
  6. Unless otherwise specified in a formal contract, standard brokerage fees (typically 2.5% of the total property sale/lease value) or property management fees (typically up to 10%) are due and payable immediately upon the successful signing of the sales or lease agreement.

  7. . Payment Protocols & Beneficiaries

    • Property Sales: The total property value must be settled directly to the Seller’s IBAN or via the Government "Real Estate Market" (البورصة العقارية) or "Real Estate Registry" (السجل العقاري) platforms as per the source of the title deed.
    • Lease/Rent: Rental payments must be processed through the "Ejar" platform or via direct wire transfer to the Landlord’s designated IBAN as specified in the lease agreement.

    • Reservation/Security Deposits: Down payments or security deposits to reserve a unit may be paid to the Owner/Landlord or to Aethel Horizons (إيثل هورايزونز) as per the specific reservation form.

    • Service Fees: All Aethel Horizons brokerage fees, management fees, and associated 15% VAT must be paid exclusively to the Aethel Horizons corporate bank account displayed on this quotation.


  8. Payment Terms & Late Settlements 
  9. Invoices are payable within the timeframe indicated on the specific invoice or quotation. In the event of non-payment by the due date, Aethel Horizons reserves the right to suspend any ongoing services, marketing, or property management activities without prior notice. If a payment remains outstanding for more than sixty (60) days, Aethel Horizons reserves the right to engage a formal debt recovery agency or legal counsel. All associated legal, administrative, and recovery expenses will be strictly payable by the defaulting client.

  10. Limitations of Liability 
  11. Aethel Horizons undertakes to utilize its premier digital infrastructure and market expertise to facilitate transactions and manage properties efficiently. However, as an intermediary and ecosystem provider, we cannot guarantee specific market outcomes or investment returns. Aethel Horizons shall not be held liable as a third party in any claims for damages filed against a client (buyer, seller, or landlord) by an end consumer or tenant.

  12. Claims and Notifications 
  13. To be considered admissible, Aethel Horizons must be formally notified of any claim or dispute regarding our services by means of a registered letter sent to our official registered office within 8 days of the service execution or invoice date.

  14. Governing Law 
  15. All contractual relations, quotations, and agreements shall be governed exclusively by the laws and regulations of the Kingdom of Saudi Arabia.
